This paper examines the legal ambiguities surrounding Large Language Model-generated content under existing Irish intellectual property legislation, identifying a gap in how copyright law handles non-human authorship. The paper proposes a preliminary framework for addressing this gap, proposing a standardized creativity test to determine whether AI-generated literary works qualify for copyright protection, and adapting the functional capacity test from the Assisted Decision-Making Act 2015 to assess whether an AI can be considered a legal decision-maker.
